Thanks for your invitation to report known instances of Fraud, Waste & Abuse which have been committed by NC Public Employees who's salaries are are paid from collected State and local tax funds.

This continuation of formal Complaints, published to employees of NC Government and others, began with [Judges-on-Trial] 016 on June 11, 2010, requesting Public Employee's expert assistance in reporting crimes being committed.
.
The intention of [Judges-on-Trial] 032 is to present you with only a few of many instances of proven Fraud, Waste & Abuse, as starting points for your investigations.
.
The number of Public Employees who received these 16 Complaints is very large. The number of Public Employees who sought to report these crimes as requested is ZERO, in direct violation of their Oath of Office and the North Carolina Constitution.
.
The number of State paid employee hours spent reading, discussing, Emailing others, meeting about, circulating and failing to respond is gigantic. While it is your job as State Auditor to come up with an exact figure of who and how many Public Employees have been involved in willful Fraud, Waste & Abuse, and how much their denial has cost NC taxpayers, preliminary estimates put the numbers at over 400 Public Employees statewide, and the cost to Taxpayers of this easily preventable Waste at $100,000 or more, not counting the cost of Fraud & Abuse.

As one example of Fraud, the Governor always responded with this statement (emphasis added): "Thank you for contacting the Office of Governor Bev Perdue – we are here to serve you and wanted to acknowledge receipt of your correspondence. If you submitted a suggestion or comment, it will be read, catalogued and referred to the appropriate staff member. If you submitted a question or request for assistance, we look forward to following up with you in a timely manner. Sincerely, Governor Bev Perdue

I have more than a hundred copies of Gov Bev's Emailed fraudulent statement. She never once followed up, timely or otherwise. Nor did but a handful of other Public Employees respond, and NONE of these public servants provided the requested assistance.

Fortunately, because by Law the State cannot destroy Emails, which are public property (even if some Employees may try to delete evidence from their State computers), you have an easily accessible source to roundup likely suspects to determine the guilty parties. As many as 6 other Networks were also distributing the 16 Complaints directly to Public Employees' Email addresses -- also similarly responded to fraudulently by Gov Bev -- which greatly compounds the amount of Fraud, Waste & Abuse involved here. You'll need to ask Dennis to search the State Email Servers and print out Hard Copies of the approximately 6,000 Email Complaints which were sent to Public Employees from genemessick@earthlink, so that you can use these as evidence against guilty parties.

[Please note that you cannot contact me at genemessick@earthlink because someone in State Government was ordered to have Earthlink, Inc. cancel my Internet Service on Friday, October 8, 2010, even though I had prepaid for my service for a year. And tho each member of Earthlink Corporation's Board of Directors in Atlanta has been contacted with a demand to restore service, they have not, and nothing has been refunded to date. If you discover in your investigations, Beth, who initiated this crime of larceny, please let me know.]

Of course, every one of the 6,000+ Emailed Complaints accepted by the State are now public information, and copies of any or all of them may be requested by any citizen or the News Media under a Freedom of Information request.

If you choose to respond to me positively regarding this [Judges-on-Trial] 032 Edition -- by indicating that you have opened investigations which both your Job, your Oath of Office, and State Law demand -- then I'll help make your job easier by giving you the other Network addresses so that Dennis can search for hundreds of other guilty Public Employees. Best guess is that this search -- bringing the value of total time spent by identifiable Public Employees engaging in preventable Waste -- will calculate out at around a quarter million dollars.

All of this Fraud,Waste & Abuse was so very easily preventable. Had Gov Bev even once told the truth, and had she only once provided the assistance she promised, the State would have taken over, and my need to keep publishing discovered corruption would have ended.
.
Likewise, had even ONE of the hundreds of Public Employees sought to report the crimes being described for investigation, the NC Attorney General would have been required to put a stop to it, and my duty to keep filing Complaints would have ended. I could have slipped back into retirement, again, from my job as an investigative journalist.
.
But to 6,000+ Complaints filed, not one single Public Employee responded that they would look into any of this. Nor did anyone explain why they would not, nor recommend who in State Government should.
.
Truth is, Public Employees of the NC Department of Justice received their 16 Complaint copies, just as did Members of the Council of State and many others in the Executive Branch. Almost all Members of the General Assembly received copies, as did all Justices on the NC Supreme Court and many other Judges as well.
.
Therefore, a significant number of Public Employees in all 3 branches of State Government are involved: Executive, Legislative and Judicial. Almost none of these Public Employees responded at all, some cases of which may rise to the level of willful Criminal Fraud.
.
And if any Department Head or other Public Official Abused her/his Office by ordering anyone to ignore or to refuse to respond to a filed Complaint, you know as well as I do that such an employee must be fired, and perhaps sent to prison. No scapegoating here, Beth: this begins at the top, and trickles down.

Here are two things to assist you in your Fraud, Waste & Abuse investigation: 1) a list below of the employees and agencies to which the 16 [Judges-on-Trial] Emailed Complaints were directly addressed; and 2) attached is a separate list of State Agencies and Public Employees who's names were not publicly published, but who nonetheless did receive all 16 Complaints, as the 6,000+ Emails produced by Dennis will prove for you conclusively.

Looking over these lists -- which includes much of the upper echelon of State Government, including yourself and the AG -- it seems unlikely that there is anyone left in State Government who's boss did not receive copies of the 16 Complaints which they refused to act upon, for whatever reason.
.
Sounds like NC should appoint a Special Prosecutor to assist your investigation of Fraud, Waste & Abuse. However, it appears there's no one who is left untainted in State Government with the authority to make such an appointment.
.
That being the case, I'll be sending a copy of this to the US Attorney General, along with other evidence, with a request that he appoint a US Department of Justice Special Prosecutor. I'm sure you will welcome the Feds expertise in pursuing this matter all the way thru convictions for those Public Employees guilty of stealing from Taxpayers.

Here's a final note for Public Employees caught up in this dishonesty. If you do not turn over whatever you know to the State Auditor, you can be fired, or even prosecuted in some instances. As made clear on the Auditor's website, State Law says you cannot be retaliated against by the State for telling the truth. While you can report anonymously, if you want the full protection of State Law, you should write what you know or suspect, sign it with your name, date and State Office, and mail it to the State Auditor's Hotline at the address shown in the first paragraph above. If you have any concern about doing this, please consult your private attorney first. And be sure to keep a copy for yourself.

Intervening time was spent gathering evidence and pleading with various North Carolina Officials to resolve this matter. The State of NC has chosen to make this an ongoing crime, which has no statute of limitations.

Abstract: Describes how, by refusing to respond to ANY of the issues raised in Editions 016 thru 031, State Employees have fraudulently wasted as much as a quarter million dollars worth of their work hours paid from State tax revenue. Website of NC State Auditor states that Complaints may be filed anonymously, and that State Law prohibits retaliation against State Employees who advance Complaints.
Response from State Auditor: NONE. Hard copy was simultaneously mailed by USPS to Honorable State Auditor. This was the final attempt to resolve outstanding issues with my native State of North Carolina, and thereby confirmed that this criminal case must be advanced to the Federal level for resolution.
EXHIBIT B - Defendants: Seventy-six ( 76 ) page copy of 16 Complaint Emails: [Judges-on-Trial] 016 thru 031, published 11 June thru 30 September 2010.
Number sent: national distribution, 16 x 24,707 = 395,312. Unknown number relayed by several national Networks, likely over 1 million.
Abstract: Establishes 1) the foundation of Grand Larceny and Attempted Murder charges against one or more Rockingham County NC District Judges; 2) the continual knowledge of and cover up for these crimes by State Officials, creating Accessories to a Felony Crime at all levels of government; 3) the refusal of State Officials to investigate and prosecute these crimes, in violation of their Oath of Office; and 4) the failure of State government to prohibit known Felons from running as Candidates in the 2010 Nov 2nd Election, at least 5 in Rockingham Co being without opposition, such that citizens could not remove them from office by their votes.
Recipients of ALL 16 Emailed Complaints include, but are not limited to: NC Governor and Council of State, NC Supreme Court Justices, elected members of the NC General Assembly, members of NC Agencies such as The NC State Bar, Judicial Standards Commission, NC Crime Commission, NC Victims Assistance Commission, among others, in addition to more than 300 Judges and Lawyers nationwide.
Response: From NC Governor to each Email: "If you submitted a question or request for assistance, we look forward to following up with you in a timely manner." No State Official ever "followed up". A complete copy identical to many dozens of Email responses sent by Honorable Gov Bev is found on page 4 of Exhibit C. Response from other NC Officials who referred crimes to proper agencies for resolution: NONE.
Result: A Governor who continuously and falsely promises resolution, while every contacted employee of State government under the Governor's authority did simultaneously and categorically refuse to respond to the more than 16,000 Emailed Complaints, sent to State Officials at all levels of government.
Exhibit C - Witnesses: Two hundred ( 200) page copy of the 22,557 Email addresses used to publish a typical Edition of [Judges-on-Trial], choosing as example Edition 031 which was the last one sent before the State of North Carolina had me arrested at my home in Virginia, and incarcerated for 29 days, with the intent of extradition to NC on false charges, as the State's chosen means to threaten and intimidate me to stop publishing facts which someone in the NC Department of InJustice did not want published. This list of 24,707 intended recipients includes both Defendants and other Witnesses to the crimes as discovered, described and published.
98% accuracy: Requested Email address Removals were accomplished prior to each Edition publication. Known faulty addresses were likewise removed. However, bounce notices typically included some "mailbox full" or "box closed" responses, amounting to less than 2% with each mailout.
Publication date: September 30 2010, beginning 1:41:03 am EDT and completed 5:52:13 am. Time required to publish example Edition 031: 4:11:10

Criminals employed within the NC Justice System caused my arrest on 21 October 2010 in an attempt to silence my wordsmithing. They caused me not to be able to vote on Nov 2nd for the first time in my life, caused my survival winter Victory Garden to freeze, and my glass teaching and fusing business to collapse, again. North Carolina's infamous ultra-Conservative US Senator NO! launched the first major conspiracy to transport huge amounts of political cash across State Lines with The Congressional Club. Once Jesse showed how it could be done, Conservatives across the nation caught on. And then, in order to keep up, every politician started doing it, crushing democracy everywhere they went. Jesse started this back in the early 70s.
One year ago on January 21, 2010, two US Supreme Court Justices refused to recuse themselves for hanging out with their buddies, the oil-rich Billionaire Koch Brothers of Oklahoma, and so they cast the deciding votes that saddled the November 2010 Elections with unlimited amounts of Koch Money pumped into political Campaigns all across America, using secret Corporate contributors, with no accountability to anyone.
Having bought the Wake Couty School Board in 2009 Municipal Elections in order to fulfill their Daddy's life long dream of re-segregating and privatizing Public Schools when he formed the racist, radical-Conservative John Birch Society, the Koches decided to use the door which SCOTUS had opened for them, and expanded their investment interests to use North Carolina as a National Test Case for the 2010 Election.
By throwing enough money at Art Pope, their NC Board member on their astroturf front-organization, Americans for Prosperity (sic), they set an ambitious plan to buy the North Carolina Senate.
By forming dozens of Teabagger Chapters across NC, the Kochs used their money to con the electorate with lies, and surprised even themselves by bagging both Houses of the NC Legislature.

Investigative journalist Gene Messick had been following the political path of 2 Berger Felons from when he lived with them in the city of Eden in Rockingham County, including trying to defeat them both in the 2006 Mid-term election. Suddenly, one of their corrupt Judges stole everything Gene owned, reducing him to poverty, and repeatedly threatened to throw him in jail if he made any attempt to get anything back, including his passport, deceased parent's possessions, and all property from his 25-year old business. With no means of support, they expected Gene to go die under a bridge somewhere. But he survives on Social Security.

At Noon on Wednesday, January 21st, the new NC Senate Majority Leader Phil Berger, Sr. consecrated the Koch Bros General Assembly while knowing full well that he is personally guilty of a variety of felony crimes, including Accessory to Grand Larceny and Attempted Murder, and Interstate Conspiracy to Commit False Arrest and False Imprisonment, among other pending charges.
Berger Felons are not worried. They have the full power of the Koch Brother's Billions behind them, and the knowledge that the Koches bought – and can buy again – decisions from the US Supreme Court.

A dozen years ago, the Superintendent of the Blue Ridge Parkway where deer run wild, before I forced him into retirement (and who had been the Director of the National Park Service under Gerald Ford), would have watched this while serving his Rethuglican political buddies deer steaks and bear stew poached off the Parkway, at an occasional Fall or Spring weekend retreat at a former timber company lodge that had been donated to the Park Service, near Soco Gap NC. They washed down their fare with booze which he "asked" the non-profit Friends of the Blue Ridge Parkway, Inc. to buy and donate to him, an organization which Gary started to raise money for his pet projects that the Interior Department would not budget.

But Gary would not allow FotBRP to sponsor programs on the 469-mile long Parkway itself for years because he couldn't get along with their Board of Directors. They continued to exist, by creatively figuring out how to support the Blue Ridge Parkway by sponsoring events just off the physical Parkway property itself, which is less than 100' wide in its narrowest places. Clever bunch we were back then!

I didn't nail Gary for the booze, poaching, and illegal use of federal property (which include use of Parkway personnel who had to set up his shindigs, including cooking poached meat on site) but it helped. As did my defeat of Gary's attempted trade with Rethuglican Congressman "Chainsaw Charlie" Taylor, to build Gary's dream of a HQ on the Parkway instead of being in a downtown Asheville tall office building, in exchange for the Congressman's notion of building a totally inappropriate 4-story I-Max theater on the federal public land of the Parkway to promote private western NC economic development.
Tapping a captive audience to boost commercialism is against the purpose of the Parkway, tho that made no difference to Charlie, as it does not to Rethuglicans today, either, who'd just as soon sell off our National Parks to their Corporate commercial operators and real estate developers for a pittance of their value. Just think of the billions that can be profited by selling off prime private condo sites overlooking what now belongs to us all.

What I nailed Gary for was – him being a Civil Engineer by training – misappropriating funds by having oversized water mains built to the HQ site, big enough to support the fire protection system for Charlie's NOT approved I-Max theater next door. This I suspected before going on a trip visiting great friends out in Colorado, and up into Rocky Mountain National Park. I decided on the way back, by train, to stop over in Denver, and go to the Denver Service Center where all NPS design work is done, or at least approved.

Using my claim to having been a Prof at Cornell Architecture, and telling them I had successfully challenged Gary on a $164 charge for Freedom of Information Act materials all the way to the Inspector General of the Interior Department, I bluffed them into letting me go fishing thru Parkway files without having to go back home to NC and filing a FOIA request by mail. I had them make copies of selected documents, including the water mains specifications, and Gary's large additional expense of building himself an escape back door and elevated ramp to exit the HQ from his office without going thru the lobby so employees would not know he had left the building. Sometimes you do whatever you have to do to catch a thief.

Gary got his HQ building, a very fine structure with the expensive exit door system in place which had added an expensive 10' to the length of the building, now named after him on the condition that he retired. But the Congressman did not get his I-Max. It's site is now the excessively large parking lot next to the HQ building on Hemphill Knob, connected by a very wide foot-bridge that was supposed to lead from HQ to I-Max. HQ business parking is around on the front of HQ, where it was always planned to be. Thus far, the parking lot has not been converted into an inappropriate 4-story I-Max theater.

I had inside assistance from Dr. Garrett Smathers, then retired as the Chief Scientist for the National Park Service, who started his career on the Parkway long ago, writing many of the descriptions of local history and culture you find carved into wooden signs and on writings displayed at overlooks. He knew what NPS was – and was not – supposed to be, and he alerted me, as an Officer at Western NC Alliance about Gary's manipulations with Charlie to get his 20-year dream of a HQ built. I was kicked out of the WNC Alliance for challenging the Parkway Superintendent and Charlie's plan, by Exec Director 'Brownie' Newman who was seeking backing of the Cecil family, owners of the premiere private vacation attraction, the Biltmore Estate, which would have been promoted at public expense by Charlie's I-Max. Brownie sold out then, and is now the Cecil's man on the Asheville City Council, pretending to be an environmentalist.

On one visit to Waynesville where he lived, Garrett took me to a place where the tectonic plates of pre-history collided, up ending into what we call the Appalachian mountain range of today. I will not tell where it is, because it's at an unidentified overlook, and if it were known, that peak would disappear from souvenir rocks carried away, just as I did!

Converting wild animals into domestic pets, BTW, as in this home video, is not in keeping with Park Service Policy and many state's laws. You're forgiven this time, only don't take down your backyard fence hoping to tame some does!

Thanks, Mike. Yeah, I did it. By working for myself as my only taskmaster, I taught glass classes and did craft shows on weekends, leaving some mid-week days free, except for when I was making glass for a show. So it was really just a time management thing, which fit into what others discovered and fed to me, much the same as I'm working now, except with my glass business collapsed, I'm researching and writing full time at the same salary: nothing. I could have done more glass, but I had enough money to get by on, and I never intended to be a rich person; perhaps not quite so poor, but poverty, too, is a fantastic learning experience, as is all of life.
I was living in my hometown of Shelby at the time, and was why I got involved with WNC Alliance in Asheville, a great environmental group who saved thousands of trees at a time, from timber cuts in the National Forests of WNC, because it was something worthwhile to do, only an hour away. As much as they mistrusted the Forest Service, unfortunately they totally trusted the Park Service. I had moved back to Shelby after decades away – leaving after High School, never intending to return – to house-sit while my Mother went to try on an apartment at the Methodist Home in Charlotte. So I had no house expenses other than paying utilities, which actually a little fund my Dad had left covered that, taxes and repairs. I could run my Statewide & SE Region craft shows and glass classes from anywhere in central NC near an Interstate, one place being as inconvenient as another.
My 'little while' in Shelby turned out to be 7 years, until she passed. By that time I had re-met Joyce, and moved to Eden with her, another failed textile town that was so much physically like the old neighborhood I grew up in, it was uncanny. Even both houses were built in the same year, 1927, and both had had coal cellars, 2 floors and an unfinished attic, tho her house was a little larger and more pleasant with 2 sun porches instead of one. The hundred year old big oak trees lining the streets were the same varieties, and one block away was Washington Street, the main thoroughfare in downtown. I grew up on Washington Street in Shelby. Only occasionally did the similarities freak me out, but, then, I was marrying the most wonderful woman in the world, so what could possibly go wrong?
God protect me if I should ever notice another set of bundled coincidences again.
Like all investigations, you discover something that smells fishy, and/or people tell you things in an off-hand manner of ordinary conversation that begin to fit with other pieces you find. You ask questions, look at stuff, and either it becomes something, or it doesn't. Just plain old grunt work. In this case I had a gold mine of information from Garrett, and so I could move very quickly from initial understanding to newspaper articles to conclusion, which took, I wanna say, less than a year. But maybe more. I don't know, because all my records of everything I ever worked on, including all the boxes of papers I got from the Parkway, were stolen by Jo-ice's Judge on July 6, 2006. I left NC for my own safety and landed in VA. Have not received back a single thing that was stolen, and do not go to NC for fear of being arrested on trumped up charges which I cannot hire a lawyer to fight.
Garret is probably gone by now, because he was in his 70s and not in great shape then. I introduced myself to the next Superintendent after Gary, Dan Brown, soon after he arrived from Natchez Trace Parkway, meeting with him and some of his staff at the new HQ Building, assuring them I had no further problem with the Parkway and wishing them well. He retired after 5 years, and I knew the current Superintendent when he was the 2nd in command over at Great Smoky Mountains NP while all of this was going on. We are from the same County, tho did not know that until later, he from a more rural part. I dropped in on him and the Parkway Chief Planner, and have worked with them on my
project.
Gary was a uniquely strange mountain man from Lenoir NC, who somehow worked his way to the top, having been born near Lenoir NC. Normally when a National Park Service Director leaves, he does not reenter the Service. He was chosen when Ford came in after Nixon resigned, and left when Repub Ford was replaced by Dem Jimmy Carter. US Senator Robert Morgan, an NC Dem, told Gary specifically that if he came back to NC to be Superintendent – definitely a step down – he was not to get involved in NC politics. Once in place, Gary ran his own show with a tight hand for 20 years before he ran into me. One of the reasons I took this on was stories about him driving some of his women employees to tears by the way he berated them. I will not put up with that, especially not from people in public service, paid with tax dollars. I decided I would do whatever it took to relieve him of his duties, and with the help of others, I was able to.
I recognized I was given a gift of freedom to do whatever was necessary, not hired by, nor beholden to, anyone, and so I used it. My glass work paid the way, tho few I taught on weekends knew what I did with the rest of my time. Prior to that, I had fired the President of a Community College, a similar sociopath, which took most of 3 years. Then with no desire to do so, I ejected the total nut-case hired as a new Exec Director of the Southern Highlands Highland Guild, which earned me two interrogations by the Secret Service and a lie-detector test, but that's another story. She took less than a year, I think, before she imploded, but I lost my Guild Exhibiting Membership because she rallied Members to her side, as sociopaths will always do, so I've learned. She did me in before I could get her gone, which happened a week or 2 apart. It was about then that I realized I had crossed some kind of threshold into a warrior class of public service. It has its rewards, but no one really likes you, and it is lonely at times.
After retiring Gary from the Parkway using a campaign I called Parkwatch (adapting a logo taken from signs with a phone number posted upon entering the Parkway), I retired from public service when I moved to grow my garden in Eden and married Joyce. Providence blessed me with an unexpected opportunity to buy a small piece of undeveloped land adjoining the Parkway together
with Joyce before we were married. I paid my half of the deposit on Visa. Joyce and I always kept our money separate, even after marriage, splitting grocery bills, and taking each other out to dinner. The deed contains a rare and very unusual Right of Way for a driveway connecting directly onto the Parkway, signed years ago by none other than Gary. That told me it was meant to be. My plan was to build a small outdoor warm-weather glass fusing teaching studio there, only a little over an hour from Eden. That was before Jo-ice emerged from hiding to trash so much.
Today is Joyce•Joy!•Jo-ice's birthday, and I was going to write something. It's getting dark outside my windows: perhaps this wordsmithing will have to do. IT is the same age as my estranged sister, who she co-opted, and as my previous wife, mother of my 2nd son, who they co-opted. I have no idea where Brinkley is. For the book, I call them the Jo-ice Sisterhood.

Edition 169 as supposed to have been written on Year 4 +118, which was Sunday Oct 24th, my son Brink's 29th Birthday, but I had been arrested 3 days before. When my wife's sociopathic personality Jo-ice emerged from the 3-in-1 to take Joyce over, I was thrust back into what I had no desire to go back to, but did. It's taken several years to build back my courage level again, but after being falsely jailed by Jo-ice's Judge, now I have it fully intact. Damn the torpedos and full speed ahead. My life is not going to end as a dud. I'm going to send people to prison where they belong. I'll be visiting my shrink tomorrow to make sure I'm flying on the level. He came on board when I was coping with panic attacks and nightmares after being released from jail, and having to live in sight of it, picking up my mail across the street from it. He has been a wonder to have in my corner.
All this writing had to come from memory, and the key that unlocked what I had not thought much about for years happened when I decided to make Glenn Beck a National Monument, followed by my [Foreground] piece which unleashed another cache of Parkway memories. When the deer/dog video arrived by Email 12 hours ago, the memory floodgates opened, and I started writing, not knowing where it would lead. That's the greatest reward for being what I term a 'wordsmith'.

[Jo-ice] 170: Happy Valentine's Day 2011 YEAR 4 + 231
Before Edition 169 published on Joyce's 66th Birthday Feb 8th, I knew I would have to do something different for St Valentine's Day. That's the problem with having a birthday too close to a holiday. My 2nd wife's birthday was Dec 18th, and you know what that meant: Why give 2 when 1 will do! But I taught myself then to do the proper thing, and carried it over with Joyce.
For her birthday, I always took her to a fancy restaurant in Greensboro, usually trying out one we had not been to before, and a movie after. For Valentine's Day, it was special gifts I'd found somewhere, like brie cheeses and fancy chocolates, and/or a new piece of Heart-theme variation of glass I designed just for her, never to make to sell.
I assume she has all of those things, unless she smashed the glass, like she most likely did for all my work on display in our Sun Porch Gallery and throughout our home. She also has everything she ever gave me, taken back when Jo-ice had ITs Judge steal everything I owned 4 yrs + 231 days ago. Never saw a single thing ever again. Judge said in his private courtroom that if I ever tried to get anything back, he'd send me to jail. Last October, he sent me to jail for 29 days anyway, 'cause I'd been exposing too much of his corruption by posting it on the Internet.
Plan was, I figured out, to arrest me on a Felony Warrant without Bond, swiftly extradite me back to his Rockingham Co Jail in Wentworth (across the street from where I taught Stained Glass Workshops for years for the Rockingham Co Arts Council), lock me up and loose the key. Judge Freddie had been unable to kill me by stealing everything I owned, including my quarter century glass business: I was supposed to die living under a bridge somewhere.
At least, that was the plan Jo-ice, her trampy little lawyer and 2 of ITs Judges had worked out. That failed, and Rethuglican Rock Co DA Phil Berger Jr also failed 4 years later to shut me away in his jail. One more strike, and they're out.

I was reminded of one of the neatest gifts I gave, actually to us both, by an ad on the inside cover of the Newsweek found in my PO Box this week, dated appropriately, today. It has Joyce's name on it, but my mailing address. Jo-ice has been sending them once a week since Jan 25, 201o, YEAR 3 + 212. I keep them all to prove malicious harassment.
The ad was for a BOSE radio CD player, which went then for $500. I later also bought one for my 2nd son's Birthday, the one who Jo-ice, and her Sisterhood of his Mother and my Sister ran off. Haven't heard from him in 4 years. No idea where he is. Left right after I finished paying for 5 years of college. Well's dry: time to move on. He turned 29 three days after I was arrested and jailed. Didn't get him a present.
I put the BOSE in our upstairs bedroom at 541 S Hamilton, overlooking my gardens in Eden, where I had turned the queen size bed diagonally, with a built-in headboard/bookshelf with reading lights in just the right position, because Joyce liked to read in bed. On our first date I discovered (or created, don't know which) Joy! the last of my wife's 3-in-1 personalities. I had not met Jo-ice then, but I'm certain IT's been with Joyce since her Mother brought IT out, born as protection for Joyce during childhood.
I often put on a great Billy Joel CD after preparing a tray of fruit & nibbles and opened a bottle of wine. We'd make love thru the entire CD. It was our special thing, which made Valentine's Day out of any ordinary day.
I wonder if Joyce played our BOSE when Jo-ice had Joy! phucque ITs Judge? Jo-ice had traded Joy!s charms as partial payment for stealing everything I owned to drive me away. That way, I could never claim anything that was bought during our marriage was half mine, and she got to keep all the BOSE, all of everything. I doubt she had to phucque the first Judge. Stan only got a cash payment from Jo-ice thru Joyce like Freddie did. Jo-ice's lawyer arranged it, like she does all the time for cases before these District Court Judges. Every lawyer in Rockingham Co knows how it's done, and all who have cases appearing in RockCoCourts participate in the 'skimming', I learned its called.
I really feel cheated many ways, not just from the theft of my half of the BOSE, and that I got a worse screwing by Freddie than Joyce did, but also that he benefited without payment to me of the 6 years of training I provided to Joy! By the time her Boss at Work snapped her up, Joy! was primo, like no woman you can imagine. It was letting her Boss diddle Joy! that got Joyce itchy to dump me for someone with more money who could take her on voyages. Not that I didn't. We did go to Alaska 3 times, to Costa Rica and Spain. But, she was afraid I could not pay for Guatemala in the Fall, and Warren could, so Joyce had Jo-ice come out into the open to dump me in July.
My gifts to Joyce, which she did not want to split, included renovating her entire house, attic to basement, and the Garage, Carport, and the Outdoor Room I screened in to keep mosquitos away that liked to munch on her. Don't blame them. So did I. Every woman has a different flavor, and Joy! was delicious and always juicy with a single kiss, as Freddie found out.
Makes me wonder if Freddie was trying for another lay from Joy! if he agreed to have me jailed until I died this time?
By refusing to allow us to live out our lives in the home I had made comfortable for us, Jo-ice left me only with memories of Joy!s love to have and to hold til death do us part. Can you say "prostitute"?

I preparation for these two Editions, the first since YEAR 4 + 111, which was 4 days before I was incarcerated, I wrote a note to a few chosen readers in Eden and RockCo, asking if one of them would go by 541 S Hamilton and take a few front and side digital photos of the House, and Email them to me.
What I got back was amazing. It was a website where you can actually walk down streets and turn and view anything you want to see! www.vPike.com Before I got to try it, he sent an apology, saying he should have tried it first. When I did, I saw that I could travel down the length of Washington Street, but that the photo-mapped part South Hamilton stopped one block short of 541! Bummer.

But, it was so fascinating to wonder around Eden while sitting in my office chair, that I did for a while. An low and behold, what should my wondering eye find? Jo-ice's trampy Lawyer's Office House standing empty! Had Cairo Fergueson & Stroup collapsed or moved away from 813 Washington? Did they get caught bribing Judges and cut a deal to slip away into the night? No sign on the door saying "Moved to...."
Not sure when these photos were taken, but do know the aerial photos on Google Maps were amazingly taken in the Spring of 2006, about 3 months before Jo-ice came out of the closet. How do I know? Well, I did establish the Photography Degree at Cornell, and I can read shadow angles and absence of leaves on trees, etc. in photos. Plus the dead giveaway was that from the shadow, my flagpole was still there. It's the white square next to the sidewalk, a 3' box layered with black plastic to keep down weeds, then covered with white pebbles, and later a few holes punched in to plant strawberries. A friend in Eden Emailed me once to say that Jo-ice had removed my flagpole after I was evicted.
You can see the curved walk I laid in the back yard for our wedding, my garage studio with attached solar greenhouse and if you know where to look, you can see my 10 seasonally dormant narrow strip gardens up against fences and buildings, plus the 2 pear trees that I made Pear Wine from, served at our outdoor wedding. Once I had a garden in Eden.
My Rethuglican neighbors had American flags flying, so when Joyce became Chair of the RockCoDem Party, I took our flag out of the mount on the big tree, and built a 12' tall steel pole out of pipe I salvaged from street trash, painting it silver and crowned it with an antique gold flying eagle. Then former Chair Dick Cartwright and Pat Morris fired Joyce as Chair, which they had no authority to do. But NCDP State Party Chair Jerry Meek said to do it because I was burning his fanny with all of the corruption I was discovering about him.
The Demo State Party Convention was just down the road in High Point on Sat/Sun. Joyce rode with Dick and Pat, maybe other SEC members. I couldn't go, because I had a 2-day stained glass workshop to teach for the Arts Council in Danbury, in next door Stokes County. Monday night I was tired, and instead of going to Joyce's meeting, I sent my first ever 2 loaves of zucchini bread from my garden with Joyce to her County Party meeting. I baked them that afternoon with Joyce's instructions over the phone from work. Joyce came home after her meeting and we discussed what had happened, like we always did about the Party. The current Democratic DA had arrived late from court and ate my zucchini bread for her supper.
Joyce dressed and left for work early Tuesday as a nutritionist for the Council for Aging in Reidsville. I dozed, and did leg exercises in bed to relieve hip pain from standing so long at my workshops, which was normal procedure. I was surprised to look up and see her standing in the doorway with her arms crossed, which she never did to me. She blurted out, "Dick Cartwright told me to resign and I did!" Then she turned, and ran yelling from the house. By the time I hobbled to the back door, she was in her white Honda where she had left it for a fast get-away, and speed off.
As I was to later figure out, totally embarrassed Narcissist Joyce had been with me, slept beside me, for 11 hours, lying all the time. That's when Joyce broke down, and called up Sociopath Jo-ice to cover for her lies. No matter where I tried, or how (phone, email, visit to her office) I could not find her that day.
She was with her trampy lawyer 2 blocks away, completing their plan. At 10:30 that night, 2 Deputies arrived to evict me from my home. Eight days later, having been charged with nothing, nor convicted of anything, Judge Freddie, who I had never met, but who knew Joyce, stole everything I owned, business and personal.

This week I found these numbers in a file that I'd copied in 2008, as I kept trying to figure out what happened. Amounts are probably higher now.
Using 2008 as a midway average since the theft occurred, Freddie has been paid more than a half-million dollars by the State of North Carolina since he stole everything I owned, not counting what he skimmed.
I realized that I'm living in poverty, and this Felonious Judge lives in luxury + skimming + phucquing my wife.
What is wrong with this picture?
It's not consolation enough to know that every lawyer in Rockinham County shall burn in Hellfire for eternity.
I decided in jail that each and every one of them should experience the wearin' 'o the Oranges, be dragged around shackled and manacled hither and yon, and never ever be able to mis-practice law again for having been convicted of a felony.
We are well on the way to seeing that day happen. Just this weekend, I placed in the mail 14 copies of the following letter to Officials in Virginia. The proverbial shittt will hit the fan in tomorrow's mail. Enjoy your preview tonight.

Greetings to all:
On this day, being the birthdate in 1809 of both Abraham Lincoln and Charles Darwin, I received at my Post Office Box another refusal by Assistant Commonwealth Attorney AS to provide requested information regarding my false arrest and false incarceration for 29 days, beginning on Thusday, October 21, 2010, and ending with my release by order of Judge RD, signed at approximately 9 am on November 18, 2010.
Although I was awakened at 4 am on Nov 18th in my jail cell, and transported 25 miles to a detention cell outside a courtroom in the Courthouse, I was not allowed to be present at my release hearing. My court appointed attorney came into the small elevator lobby where I had been brought shackled, to tell me that the case against me had been dismissed. However, I was not actually released from custody until after dark that evening, approximately 5:30 pm, some eight (8) hours later.
After the Judge signed my warrant dismissal, during those 8 hours I was transported approximately 60 miles between 4 separate jails, manacled and shackled during transportation, until I was unlocked and released in the dark parking lot outside the Jail, only a few thousand yards from where the Judge had ordered my release 8 hours previously, one of the first cases in his Court that morning.
I am not a lawyer, and cannot afford a lawyer, living now on Social Security benefits. Apparently my Court Appointed Attorney has been removed from my case. I do not know how many laws were broken during this case, but cruel and unusual punishment surely is one of them, in addition to numerous felony counts of engaging in a conspiracy with Officials of another state to commit a false arrest and to cause false imprisonment.
I have been a law-abiding citizen of the Commonwealth for more than 4 years. When I came here and re-established my small business that I operated in NC for a quarter century, among other things, I registered to vote and did vote in each election. I obtained Library Cards for the County and Virginia Tech Libraries. I established an account with the VA Department of Taxation to pay Sales Tax regularly and did so. And each Spring/Summer I planted a small vegetable garden to supplement my food supply, which I expanded in size each year, using produce to freeze and can to tide me over Winters of low business activity.
I taught dozens of separate fusing glass workshops for the Parks & Recreation Department, and stained glass workshops for VaTech's Reynolds Homestead in Critz, continuing a dozen years of doing so from NC.
Then came my arrest out of the blue with no warning by 5 unidentified presumed Officers of the local Police Department at my apartment on October 21st. No one showed me any identification, nor read me any rights. I was cuffed and hauled away, not allowed to take care of anything. During my 29-day incarceration, at least the following occurred: I was not able to vote on Nov 2nd, for the first time in my life. My garden froze, destroying all last-harvest food, intended to provide for my Winter survival. Therefore, I have been forced to apply for food stamps, something I never in my life wanted to do. I owed over $50 in Library fines.
I was forced to solicit the assistance of professional counseling, at great difficulty finding someone who would accept Medicare payment, to treat my panic attacks and nightmares, because both the Courthouse and Jail appear from my apartment windows, and each time I exit the building, they being 3 blocks away. My Post Office Box is across Main Street from the Courthouse, half a block from the Police Station, meaning that I have to re-live some very awful memories every time I go to get my mail. I cringe even when a neighbor knocks on my door. I will become a septuagenarian on May 1st.
I had scheduled and advertised by Email to over 500 former customers and students an 8-day pre-Christmas Super Sale at my glass Studio, to assist them in making holiday gifts. I was arrested at 5:30 pm on a Thursday after returning home from working all day setting up for the Sale, scheduled to begin at 10 am the following morning on Friday. I was not allowed to earn the money I needed to help survive Winter. On Thanksgiving Day, a friend with a strong back came from NC to help me load out my business into storage, closing down my 30-year glass career.
Persons in North Carolina caused me to be arrested in Virginia on a felony charge without bond, expecting that I would be swiftly extradited to NC, and jailed indefinitely on false charges, disrupting my life as much as possible. The intention of known criminals in the Rockingham County (NC) justice system was that I would be in jail right now, and that I should die in jail. No Official in Virginia bothered to check this out.
Given that I was never provided a satisfactory explanation of why I was being arrested and jailed, because no one I asked during those 29 days knew, after release I began trying to trace whatever records might exist. I bought copies of my file from the Clerk of Court. Immediately after, I interviewed my prosecutor. I have written 3 letters to the Asst CA requesting records about me which he has refused to provide, claiming he "believed" they were immediately destroyed.
I wrote 2 letters to the Police Department regarding identity of the arresting Officers and details of their instructions from someone in the State of North Carolina. Only partial and incomplete information was supplied, and further assistance refused.
I am a citizen of the Commonwealth. The job of these Officers and the Court was and is to protect me, and not to do the bidding of unknown persons outside Virginia. This duty was forfeited by everyone involved in this case, without any attempt to determine if claims being made by a person or persons unknown to them in North Carolina were true. I was repeatedly told by the Police and Magistrate that they did not care what I may or may not have done in NC, that they were arresting and holding me without bond for extradition to NC, based solely upon a request made over a telephone by a person unknown to them. No investigation of any kind was ever conducted.
It appears that no one during the 29 days of my incarceration checked into the validity of this case until after my first Extradition Hearing before the Judge on Nov 17th. Once I refused to waive extradition, only then did my prosecutor call North Carolina. The Asst CA claims that NC dropped whatever charges they had against me that same day, because I refused extradition (which had exposed their criminal intent), and only after I had been sitting in jail for 29 days, suffering the extenuating damages which this false arrest was fully intended to cause. He said the Judge had gone home, so he waited until the next morning to tell him, allowing someone who he knew was innocent to remain in jail another night.
This letter is NOT about a civil case for damages. I have tried every way I know to determine what happened in Virginia to cause this. I am being refused critical information about me which the Commonwealth possesses. It appears that various Officials in the Commonwealth comprehend that they did wrong, and that they believe by refusing to provide me with information I requested, that I will give up and go away.
This is my final request to all the Virginia parties involved to produce all information I have requested, written or otherwise, before the end of February.
I have bent over backward to avoid filing charges against guilty parties in Virginia. My interest is for trying to determine who the criminals are in NC who are behind this conspiracy.
However, should the Commonwealth fail to fully cooperate, my next letter shall demand that every employee of the Commonwealth who had anything to do with this case be fired posthaste, and that they each be arrested on appropriate felony charges. Failure to do that will automatically send this case to Federal authorities.
Your continuing refusal to provide ALL information in my several written requests shall confirm your criminal intent to have committed felony crimes, and/or to cover up commission of felony crimes.
I await receipt of your information by mail by no later than February 28, 2011.

The number of Rockingham County residents who will spend part of their lives in prison is being added to by those who they snookered into joining them in an Internet Conspiracy to commit felony crimes of false arrest and false imprisonment. Except for all of the Private Lawyers in Rockingham who joined the conspiracy, these are public employees, paid from tax funds, and will be stripped of their licenses, pensions, and jobs before they go to prison.
A lot of people thought they could cover this up, all the way from the Courthouse in Wentworth to the State Capitol & Legislature in Raleigh. But the longer it lies unattended, the more people it corrupts. As of February 28th, Officials in the Commonwealth of Virginia who DA Phil Berger Jr invited to join him are added to the Federal Complaint.
It's clear to see why no one will touch this. Every case which has been tried since this corruption began in 2006 will have to be reviewed to see if Judges skimmed them, too, or if they accepted sexual favors as partial payment for the favorable verdicts they rendered, one did in my case.
When the dam finally breaks, it will wash away a lota trash in Rockingham County, hopefully forever.

[Jo-ice] 171: Looking back over the past 5 months YEAR 4 + 251
Normally I write these [Jo-ice] Editions early on Sunday mornings, as a kind of break from the daily push to publish "relevant" stuff. They had become a kind of informal Backstory to other wordsmithing, up until I was arrested and sent to jail for 29 days. Everything after that changed.
Yesterday I planted snow peas and sugar snaps in ground I'd been preparing for 3 weeks whenever it was warm and dry enough, finishing just in time the day before rains came. Starting 3 weeks ago, I broke up a still frozen new strip of lawn, built retaining timbers, and began making a lasagna garden: crumbled clay soil mixed with some vermiculite, layered with leaves, lime, more soil, kitchen compost, leaves, fertilizer, and more soil. It's a method of soil prep which I do every year, but usually in Nov/Dec after last frost, before the ground freezes. But this year, events intervened, and the cold came early to stay longer.
For instance today, while I'm typing this, it's snowing outside! Not much yet, but with a lota wind, so big white flakes are flying by my window, almost horizontally. Ah, well. Snow peas and snow go together!
This morning, I was looking at the 'stats' for my Website http://earthhome.us curious what caused the spikes in daily readership. Small independent websites like mine rarely show up on Internet Searches, but depend more on self-advertising, like me including Links inside other things I publish. Some wordsmithing goes into national Network distribution, some are just NC. The Palin Petition Edition went national, as did the [Wisconsin SOLIDARITY] Editions. Declaring Glenn Beck a National Monument on Ronnie Raygun's 100th Birthday went off the chart after Palin did. I had rebuilt my Website entirely on 1-1-11.
So, I started making a list of when things happened, and like all lists, it tended to get longer and longer. As this picture unfolded, patterns emerged that I had not noticed before. Like how long certain Editions got stalled out, and how much I had to struggle with myself to get them back up and running again. It would have been so easy just to lay down and die, like they wanted me to. But, then, look at all the fun we would have missed!
This Edition of [Jo-ice] is going to a very select group of folks, some friends and acquaintances, but mostly its for those who have been assisting in one way or another during this truly unique 5 months. It's a way of saying "Thanks!" for being there, but also to say "Look what we did!"
Never have I composed a list that contains so many people who deserve to go to prison.
I keep waiting for the day when things get back to routine, but who the heck wants that!
